JX Media - Terms of Service
These Terms of Service (“Terms”) form a binding agreement between JX Media (“the Photographer / Content Creator”) and the client (“the Client”) for photography and/or content creation services. By booking any service with JX Media, the Client agrees to the following terms.
1. Booking & Payment
1.1. A 30% non-refundable deposit is required to secure all bookings.
1.2. The remaining balance is due no later than 7 days prior to the scheduled session or event date, unless otherwise agreed in writing.
1.3. No booking will be confirmed until proof of deposit payment has been received.
1.4. JX Media reserves the right to cancel any booking where payment terms are not met.
2. Rescheduling & Cancellations
2.1. The Client may request to reschedule their session by providing at least 5 days’ written notice.
2.2. If the Client cancels within 5 days of the scheduled date, the full deposit will be retained as a cancellation fee.
2.3. Cancellations made within 24 hours, or failure to attend the session, will result in the full deposit being forfeited.
2.4. In the event of illness, extreme weather conditions, or unforeseen circumstances beyond control, JX Media reserves the right to reschedule the session to a mutually agreed alternative date.
3. Travel & Location Fees
3.1. Travel is free of charge for the first 15km's, thereafter the travel fee is charged at R5 per kilometre, calculated from JX Media’s base location, unless otherwise specified.
3.2. Any venue, permit, location access, parking, or entry fees required for the shoot are the responsibility of the Client.
4. Image & Content Delivery
4.1. Edited digital images and/or content will be delivered within 5-7 days after the session, unless otherwise stated in writing.
4.2. All content is delivered via an online gallery or digital download link.
4.3. Delivery timelines may vary for larger events, weddings, or commercial projects and will be communicated in advance.
5. Editing, Style & Revisions
5.1. All images and video content are edited in line with JX Media’s creative and artistic style.
5.2. Raw, unedited images or footage will not be provided under any circumstances.
5.4. A limited number of revisions may be included depending on the service booked. Additional revisions may incur extra charges.
6. Copyright, Licensing & Usage
6.1. All images and content remain the intellectual property and copyright of JX Media, unless otherwise agreed in writing.
6.2. Clients are granted a non-transferable personal-use license for personal sharing, printing, and online posting.
6.3. Commercial use, brand use, resale, paid advertising, or content monetisation is not permitted without a separate written licensing agreement.
6.4. Images and content may not be altered, filtered, cropped excessively, or edited without written consent.
6.5. JX Media retains the right to use all content for portfolio, website, social media, marketing, and promotional purposes, unless the Client submits a written opt-out request prior to the session.
7. Liability & Limitations
7.1. The Client participates in the session at their own risk. JX Media is not responsible for injuries, loss, or damage to persons or property during the session.
7.2. In the unlikely event of equipment failure, data loss, or circumstances beyond reasonable control, JX Media’s liability is limited to a refund of payments received.
7.3. JX Media is not liable for missed moments due to uncooperative subjects, environmental conditions, or venue restrictions.
8. Model Release
8.1. By booking and participating in a session, the Client grants JX Media permission to use their likeness and that of any participants for promotional purposes as outlined in Section 6.
8.2. The Client confirms they have obtained consent from all individuals appearing in the session, including parents or legal guardians for minors.
9. Agreement
By booking a service with JX Media, the Client confirms that they have read, understood, and agreed to these Terms of Service in full.
